was no nurse at their daughter's school the day she was sent back to class with a fractured elbow instead of to the hospital.... fox-5's vince sapienza.. spoke with the frustrated mother and is in the newsroom with how this happened. john..cyndi.... i'm told the child was playing on the monkey bars during recess.. when she fell and broke her elbow... now the parents i spoke with said recess is usally around 11 a-m... when they went to pick their daughter at 2:40 from school... she was hysterical.. and in pain.... and according to the family.. had been since she fell... now the video you're looking at is lleylan eisenouer at the hospital... needing to use her right arm... just to lift her left arm up... as you can see the elbow is swollen.... doctors say it was a clean fracture... prompting the full arm cast... the parents say doctors could not believe how much pain lleylan was able to endure throughout the day without being seen.... the mom says she

different times and seen by the attendance worker.. since there is no nurse at the school... she said all that was given to her was some ice... "it's upsetting because i feel like lleyan was in pain, for a long time and i'm scared for the other kids at this point, because there isn't a nurse there, they're using their office staff to help tend to the kids." now shortly after that interview....i received a statement from vox solid communications... a firm that represents coral academy....it read... "coral academy of science at nellis currently has a full-time nurse on staff. in this particular case, the student was not in distress, nor did she have any discoloration, etc. we have since resolved the incident with the student's parents and no further action is needed." now after getting that email.. i called the school to confirm if they did have a full time school nurse.... they said yes... i asked when was the nurse

year-old aleksandr khutsishvili is the man who was shot and killed in a starbucks in southwest las vegas sunday. police say pedro garcia became angry when his card was declined in the drive thru... went into the starbucks... got into an argument with cut-zek-feely and shot him. fox5's kathleen jacob is live at the starbucks which opened just a couple hours ago. kathleen what have we learned new today? guys... the biggest thing is the identity of the victim... alexandre cut-zek-feely. we're still working to learn more about him... but right now we

at one point he lived downtown. now the starbucks is back open... and today we saw people coming in to pay tribute to the victim and people that went through this. i just wanted them all to know that my thoughts and my prayers have been with them for the last few days and for them to just stay strong and to get through this, you know we're all thinking about them. for cindy westergard... the shooting at starbucks hit hard. my brother did lose his life at his job 11 years ago. so for her... visiting the starbucks employees that witnessed the deadly shooting at work is a priority. i was just mortified and so scared for all the people working here. she wasn't the only one... the first customers in when the store opened back up were a group of metro police ... after a long and lengthy investigation that began sunday just after eleven. they say pedro garcia is the man who came in.. fired a gun twice into the air.. and then shot cut-zek- feely. we reached out to garcia's wife.. who

m-g-m is opening a one-point-four billion dollar smoke-free hotel in maryland. this has a few nevadans pushing for a smoking ban in our casinos. advocates for "smoke free gaming of america" held a rally today. their goal is to get all nevada casinos to ban smoking for the health of the public and hotel employees. they remind us-- secondhand smoke can cause multiple health issues... including heart disease... heart attacks... asthma... and lung cancer. "across the united states, nearly 800 casinos and gaming organizations are smoke free. so elsewhere they've already taken that step. for whatever reason, nevada is insistent on not protecting the health of their workers. it's an easy fix. a smoking ban simply involves picking up ashtrays, voila, you're smoke free." a clean in-door air act was passed by nevada voters in 2006-- although it excludes casinos... bars and taverns. the global gaming expo is in town all week. and a few new slot machines are making their way to casino floors across the strip. i think it's a great

"any time you have kids involve that makes it a little bit harder. a lot of it is unknown..a lot of it for the officers is the way our portion of this transpired. again not knowing a lot of the background, not knowing a lot other than the mere fact that there is a car parked behind our police station and there are two deceased young kids
